(1) Provision shall be made in the provincial law so that the posts of the chairman and members of the Commission shall be vacant on the following basis:-
(a) If he resigns in writing to the Head of the State,
(b) If he attains the age of sixty-five years,
(c) In case of dismissal according to sub-section (5),
(d) If the head of the state dismisses him from office on the recommendation of the committee under sub-section (2) of section 3 based on the recommendation given by the medical board constituted by the state government that he is unable to perform his duties while in service due to physical or mental illness,
(e) In case of his death.
(2) One-fourth of the total number of members of the Provincial Assembly who have committed a serious violation of the Constitution and prevailing laws, lack of efficiency or bad conduct, or have not faithfully complied with their official duties or have seriously violated the code of conduct, are unable to fulfill their official responsibilities. He can submit a proposal of accusation against the member.
(3) If a proposal of accusation is submitted and registered in accordance with sub-section (2), an inquiry committee will be formed in the Provincial Assembly to investigate and submit a report regarding whether the grounds and reasons mentioned in such proposal exist.
(4) Provisions related to investigating the proposal of accusation against the chairman or member shall be as mentioned in the provincial law.
(5) If the committee under sub-section (3) submits a proposal to the provincial assembly with a recommendation to vacate the position, and if the proposal is passed by a majority of two-thirds of the total number of members immediately existing in the provincial assembly, the chairman or member shall be relieved from office.
(6) A person who has been discharged from office in accordance with sub-section (5) shall not be able to take any benefit from such office and may not be appointed or nominated to any public office in the future.
